Hetrick v. Ohio Dep't of Agric.

Summary: In this case, the court of appeals reversed the trial court's decision to grant appellee Hetrick's dangerous wild animal (DWA) permits. Hetrick was the owner of DWA's on his property, and according to an Ohio law he was required to register the DWA's and apply for permits before a certain statutory deadline. This court held that the trial court abused its discretion in finding that the Ohio Department of Agriculture (ODA) lacked a statutory basis to deny the application for a rescue facility permit on timeliness grounds but did not err in so finding on caging and care grounds. Further, the court reversed, in part, the judgment of the Wood County Court of Common Pleas in the rescue facility permit case; reversed, in toto, the judgment of the lower court in the wildlife shelter permit case; and with this decision, reinstated the ODA's denial of both permits. Judgments reversed.

Gill Terrace Ret. Apartments, Inc. v. Johnson

Summary: This is an appeal of a trial court's ruling in favor of a landlord finding that the tenant violated two material terms of her residential rental agreement. One of the material violations involved the keeping of a pet in violation of a no-pets policy. The facts show that the dog, "Dutchess," initially came to the tenant's apartment in 2009 with the tenant's son. While the dog never attacked another person or pet, it did display aggressive behavior, including lunging, baring her teeth, and rearing up on her hind legs. Other tenants expressed fear of Dutchess. After the son moved out in 2013, the dog stayed, and, in 2014, the landlord sent tenant a letter indicating the keeping of the dog was a violation of the lease. Two months after that notice, an informal meeting was held and tenant then claimed the dog as a reasonable accommodation for her disability. The landlord's attorney sent paperwork to effectuate this request, which the tenant said she never received. Months later, the landlord served the tenant with an eviction action to which tenant responded with a request to keep her dog as a reasonable accommodation. The request to keep a pet as a reasonable accommodation was granted shortly thereafter by landlord; however, the landlord did not approve of Dutchess as the specific animal due to concerns of behavior and hostility toward other residents. At an eviction hearing in June of 2016, the landlord's request to terminate the tenant's lease was granted by the court, which concluded that the reasonable accommodation for an assistance animal did not extend to Dutchess. On appeal, the Vermont Supreme Court noted that a request for an assistance animal as a reasonable accommodation may be denied if "the specific assistance animal in question poses a direct threat to the health or safety of others." While there was no dispute in this case that the tenant has a disability-related need for an ESA, there was credible evidence that supported the lower court's decision that Dutchess posed a threat and/or would cause substantial physical damage to the property. This included testimony from other tenants and tenant's own statements that she might not be able to control Dutchess. The court stated: "[l]ike the trial court, we acknowledge tenant's attachment to Dutchess and her need for an emotional support animal, but the court properly weighed the evidence regarding Dutchess's aggressive behavior against landlord's concerns for the safety and wellbeing of the other residents." The court concluded that the lower court did not err in affirming landlord's denial of tenant's reasonable accommodation request.

Justice v. State

Summary: In this Texas appeal, defendant Brent Justice contends that his conviction for a single count of cruelty to a nonlivestock animal was based on insufficient evidence. The incident stemmed from defendant's filming of his co-defendant, Ashley Richards, torturing and killing of a newly-weaned puppy. Justice and Richards ran an escort business named "Bad Gurls Entertainment" that focused on the production and distribution of animal "crush" videos (fetish videos involving the stomping, torturing, and killing of various kinds of animals in a prolonged manner). The evidence that supported the conviction involved the confessions of both perpetrators and the video of the puppy being tortured and ultimately killed. On appeal, defendant argues that he cannot be found guilty since was not the principal involved in the offense. This court was unconvinced, finding that the evidence was sufficient to support a state jail felony since "[t]here is no shortage of evidence that appellant aided Richards in her cruelty," including handing Richards the knife and filming the killing. The one issue in defendant's "hybrid" pro se and represented brief on appeal that the court granted was related to a finding that defendant used a "deadly weapon." After the filing of initial briefs, the Court of Criminal Appeals in Prichard v. State, No. PD-0712-16, --- S.W.3d ---, 2017 WL 2791524 (Tex. Crim. App. June 28, 2017), held that “a deadly weapon finding is disallowed when the recipient or victim is nonhuman.” Thus, in the case at hand, the court deleted the deadly weapon finding since it was directed at the puppy rather than a human. The case was remanded for a new hearing on punishment only since the conviction was affirmed for a state jail felony.

State v. Peabody

Summary: This Georgia case involves a former police lieutenant who was indicted on two counts of aggravated cruelty to animals after he left his K-9 named Inka locked in his police vehicle while he attended to tasks inside his home. The dog died after being left inside the vehicle, which had all doors and windows closed with no A/C or ventilation running. The state appeals the trial court's grant of defendant's motion to quash the indictment. Specifically, the state argues that OCGA § 17-7-52 (a law that requires at least a 20-day notice prior to presentment of a proposed indictment to a grand jury when a peace officer is charged with a crime that occurred in the performance of his or her duties) is inapplicable. The state did not send defendant a copy of the proposed indictment before it presented the case to the grand jury. The state contends defendant "stepped aside" from his police-related duties and was therefore not afforded the protections of OCGA § 17-7-52. This court disagreed with that assessment. Since Peabody was responsible for the care and housing of Inka as her K-9 handler, leaving her unattended, albeit in an illegal manner, was still in performance of his police duties. As such, Peabody was entitled to the procedural protections of the statute according to the appellate court. The trial court's motion to quash his indictment was affirmed.

Eriksson v. Nunnink

Summary: In this case a deceased horse rider's parents (Erikssons) have brought wrongful death and negligent infliction of emotional distress actions against the rider's coach after she fell from her horse in competition and died. Due to a release form signed by the parents, the coach (Nunnink) could only be held liable if he was found grossly negligent. The parents attempted to show that the coach was grossly negligent in allowing the rider to compete after injuries sustained by the horse. This court concluded that the Erikssons failed to establish that Nunnink was grossly negligent. The court affirmed the judgment.

This court found that due process was satisfied and that the ordinance is constitutionally clear, and thus affirms the order.
