Rotunda v. Haynes

Summary: The plaintiff in this case filed suit against the defendant, a dog breeder, to recover medical fees after receiving a dog that had a “severe genetic heart defect.” The dog was purchased by a third party and given to plaintiff as a gift. The court in this case held that the plaintiff was not entitled to damages under the General Business Law or the Uniform Commercial Code. The court held that the plaintiff was not entitled to damages under the General Business Law because the dog was not actually purchased by plaintiff. In addition, the plaintiff was not entitled to recover under the Uniform Commercial Code because plaintiff was unable to establish “privity with the defendant or personal injuries arising from the alleged defect,” which are required in order to recover damages. The judgment was affirmed.

Nuijens v. Novy

Summary: Plaintiff brought this action in Small Claims Court for the recovery of $254.63 after purchasing a dog from the Defendant. At the time of purchase, the Defendant gave a five day guarantee to the Plaintiff that if a veterinarian found anything wrong with the dog, the dog could be returned and the Plaintiff would receive a refund. The Plaintiff took the dog to a vet within five days and although she was told that the dog had a urinary infection, the Plaintiff kept the dog. Within 14 days of the sale, the Plaintiff learned that the infection was serious, and she contacted the Defendant requesting a refund under article 35-B of the General Business Law. The Court stated that Plaintiff's cause of action under the General Business Law failed: because it did not give the Plaintiff the right to recover damages, since the statute only covered "pet dealers" or "breeders" who sold more than one litter of animals per year. There was no evidence to indicate that the Defendant sold more than one litter of puppies. Also, because the Plaintiff chose not to return the dog for a refund within five days after learning about the infection, she could not seek recovery for breach of an express warranty (UCC 2-313). Lastly, because the Defendant was not a “merchant" the Plaintiff could not recover for the breach of an implied warranty (UCC 2-314).

Overlook Mut. Homes, Inc. v. Spencer

Summary: The barking of Scooby the dog, caught the attention of nearby neighbors, and the Plaintiff, Overlook Mutual Housing Corporation. Overlook established a no-pet rule for its residents with an exception for service animals. Scooby's owners (the Spencers) received a letter warning them to remove the dog from their home. In response, the Spencers obtained a letter which requested that Overlook make a reasonable accommodation for their daughter Lynsey, who needed a support dog to facilitate in her psychological treatment. Overlook did not grant the Spencer's request for accommodation and filed a Complaint against them. The Spencers then filed a counter claim and Overlook then moved for summary judgment. The court stated that pet policies have to comply with the Federal Fair Housing Act (FHA). Based on the intent of the FHA to provide reasonable accommodation rather than public access like the ADA, HUD and the DOJ's recently revised regulations on the need for emotional support animals in HUD-assisted housing, and previous actions brought against housing providers that denied emotional support animals, this court concluded that emotional support animals can qualify as reasonable accommodations under the FHA. Further, the court held that they do not need to be individually trained like service animals. Overlook's motion for summary judgment was denied.

Summary: In this case, the District Court for the Northern District of Georgia denied the Georgia Aquarium’s application for a permit under the Marine Mammal Protection Act (MMPA) to import 18 beluga whales from Russia’s Sea of Okhotsk for public display. The Aquarium challenged the defendant National Marine Fisheries Service's (NMFS) decision to deny a permit to import the beluga whales as arbitrary and capricious under the Administrative Procedures Act (APA). The Court found that defendant National Marine Fisheries Service (NMFS) was correct in following the statutory mandate of the MMPA after it found that the Sakhalin-Amur stock of the whales is likely declining and is experiencing adverse impacts in addition to Russian live-capture operations. Further, some of the beluga whales destined for the import were potentially young enough to still be nursing and dependent upon their mothers.

State v. Crosswhite

Summary: After being tipped off about a dog fight, authorities seized several dogs from a home. Defendant was charged with one count of second-degree animal abuse and four counts of second-degree animal neglect. After the presentation of the state's evidence in circuit court, defendant moved for a judgment of acquittal on all counts, arguing, as to second-degree animal neglect, that the state had failed to present sufficient evidence from which a jury could conclude that defendant had custody or control over the dogs. Circuit court denied the motion and defendant was convicted on all counts. Defendant appealed the denial of the motion, again arguing that the state failed to prove that he had “custody or control” over the dogs. The appeals court concluded that the plain text and context of ORS 167.325(1), together with the legislature's use of the same term in a similar statute, demonstrated that the legislature intended the term “control” to include someone who had the authority to guide or manage an animal or who directed or restrained the animal, regardless if the person owned the animal. Given the facts of the case, the court concluded that based on that evidence, a reasonable juror could find that defendant had control over the dogs, and the trial court had not erred in denying defendant’s motion for judgment of acquittal.

Williams v. Lexington County Bd. of Zoning Appeals

Summary: Appellant sought review of the circuit court's order upholding the Lexington County Board of Zoning Appeals' unanimous decision that the county zoning ordinance prohibits Appellant from operating a dog grooming business at her home. The appeals court found that the word kennel, as used in the Lexington County Zoning Ordinance for Resident Local 5 (RL5), included dog grooming. Since Appellant’s dwelling was zoned RL5 and the ordinance prohibited kennels in RL5, the appeals court upheld the circuit court’s decision.

Appellant sought review of the circuit court's order upholding the Lexington County Board of Zoning Appeals' unanimous decision that the county zoning ordinance prohibits Appellant from operating a dog grooming business at her home. Colorado Wild Horse v. Jewell

Summary: Finding the number of horses too high to maintain ecological balance and sustain multipurpose land use in Colorado's White River Resource Area, the US Bureau of Land Management (BLM) invoked its authority under the Wild Free–Roaming Horses and Burros Act (“Wild Horses Act”), to declare those horses to be “excess animals” and scheduled to remove them from the land. Plaintiffs—organizations challenged BLM's “excess” determinations and its decision to remove these horses. They asked the district court to enjoin BLM's planned gather. Because the Wild Horses Act authorized BLM's excess determination and BLM appeared to have used reasonable methods to estimate the total wild-horse population, the Court found that Plaintiffs were unlikely to prevail on their Wild Horses Act claims. And because the record reflected that BLM considered the cumulative effects of the proposed gather and permissibly relied on the Environmental Assessment written for a previous East Douglas HMA gather, the Court found that Plaintiffs were also unlikely to prevail on their National Environmental Policy Act claims. The Court further found that Plaintiffs were unlikely to suffer irreparable harm as a result of the gather and that the balance of equities and the public interest weighed in favor of BLM. Accordingly, the Court denied Plaintiffs' Motion for a Preliminary Injunction.

As a result, plaintiffs were charged with over a hundred counts that were later withdrawn. Plaintiffs then filed the present case, asserting violations of their federal constitutional rights, as well as various state-law tort claims. Defendants moved for summary judgment, claiming qualified immunity. The district court granted the motion in part as to: (1) false arrest/false imprisonment, malicious prosecution of one plaintiff and as to 134 of the charges against another plaintiff, negligent and intentional infliction of emotional distress, defamation, and invasion of privacy; and (2) to the following claims in Count One: verbal abuse, security of person and property, false arrest/false imprisonment, due process and equal protection, and failure to train or discipline as the result of a policy or custom. The District Court denied the motion with respect to (1) the following claim in Count One: unreasonable search and seizure and the individual defendants' request for qualified immunity in connection with that claim; and (2) with respect to one plaintiff's malicious prosecution claim, but only to the charge relating to the puppy's facial injuries.

CITGO urged the 5th Circuit to reverse the Clean Air Act convictions because the district court erroneously instructed the jury about the scope of a regulation concerning “oil-water separators.” CITGO also contended that the MBTA convictions were infirm because the district court misinterpreted the statute as covering unintentional bird kills. The 5th Circuit agreed with both contentions, holding that CITGO's equalization tanks and air floatation device were not oil-water separators under the Clean Air Act's regulations and that “taking” migratory birds involved only “conduct intentionally directed at birds, such as hunting and trapping, not commercial activity that unintentionally and indirectly caused migratory bird deaths. The district court’s decision was reversed and remanded with instructions.
