Bowden v. Monroe County Commission

Summary: The Plaintiff, as administratrix of the estate of her late husband, filed a complaint after he was attacked and killed by American Pit Bull Terriers while taking a walk near his home. The Plaintiff filed against the Defendants, Monroe County, the County Dog Warden Ms. Green, and other defendants, alleging, negligence in performing their statutory duties by allowing vicious dogs to remain at large, and wrongful death. The Plaintiff also sought punitive damages. The Defendants filed a motion to dismiss the complaint and asserted a defense based upon the public duty doctrine. The Circuit Court, Monroe County, granted summary judgment in favor of the Defendants. The Plaintiff appealed. The Supreme Court of Appeals of West Virginia reversed the Circuit Court and remanded. The Supreme Court held that genuine issues of material fact existed for determining whether a special relationship existed between the county and the victim such as whether: (1) the dog warden assumed an affirmative duty to act on the victim's behalf, (2) the dog warden was aware that inaction could lead to harm, (3) the dog warden had direct contact with the victim's wife regarding vicious nature of dogs; and (4) the victim's wife justifiably relied on assurances from dog warden.

Animal Legal Defense Fund v. United States Department of Agriculture

Summary: The United States Department of Agriculture (USDA) regularly posted documents about the enforcement activities of the Defendant, Animal and Plant Health Inspection Service, (“APHIS”). The documents were posted on two online databases. However, APHIS grew concerned that its Privacy Act system was insufficient. Therefore, the USDA blocked public access to the two databases so that it could review and ensure that the documents did not contain private information. However, the Plaintiffs, animal welfare non-profit organizations, asserted that by blocking access to the databases, the USDA breached its obligations under the Freedom of Information Act's (“FOIA”)'s reading-room provision. The Plaintiff’s also asserted that the USDA's decision to block access was arbitrary and capricious in violation of the Administrative Procedures Act (“APA”). Plaintiff's motioned for a mandatory preliminary injunction. The United States District Court, N.D. California denied the Plaintiffs motion and held that the Plaintiffs are not likely to succeed on their FOIA claim because (1) there is no public remedy for violations of the reading room provision and they have not exhausted administrative remedies. (2) The Plaintiffs are not likely to succeed on their claim under the APA because FOIA provides the Plaintiffs an adequate alternative remedy. The Plaintiffs cannot establish that they are likely to suffer irreparable harm absent an injunction or that the balance of harms weighs in their favor in light of the on-going review and privacy interests asserted by the USDA.

The Superior Court, Los Angeles County, granted the Defendants summary judgment. The Residents appealed. At trial, the Residents were awarded injunctive and declaratory relief. The Court of Appeals reversed. On remand, the trial court rejected many of the Resident’s claims, but issued limited injunctions prohibiting use of particular forms of discipline, requiring the elephants to have specific amounts of exercise time, and requiring the rototilling of soil in exhibit. Both parties appealed. The Court of Appeals affirmed. The Supreme Court of California granted review and reversed the Court of Appeals. The Supreme Court held that: (1) the prior Court of Appeals decision was not law of the case as to the argument that the Residents was precluded from obtaining injunctive relief for conduct that violated Penal Code, and (2) the Residents' challenge to the city's treatment of elephants improperly sought injunctive relief for Penal Code violations.

The Post-Conviction Remedy for Pit Bulls: What Today’s Science Tells Us About Breed-Specific Legislation

Summary: This Article examines the pseudo-science used in the past, the science we have today, and how “pit bulls” are among the more popular breeds adopted from animal shelters safely living in communities nationwide, yet are targeted with specific legislation in many municipalities. Distinguished from criminal eyewitness identification cases, this Article looks at the breed-specific legislation issue in terms of the entire breed being convicted on eyewitness testimony, not on a case-by-case basis like we see in criminal cases. Because breed-specific legislation targets an entire population of family pets based on breed, this Article argues for a better examination of the reliability of breed identification and the science used to uphold the constitutionality of the legislation.
