Big Cats of Serenity Springs, Inc. v. Rhodes

Summary: Plaintiff, Big Cats of Serenity Springs is a Colorado-based non-profit that provides housing, food, and veterinary care for exotic animals. The facility is regulated by the Defendant, United States Department of Agriculture's Animal and Plant Health Inspection Service (APHIS). Three APHIS inspectors accompanied by sheriff's deputies broke into the Big Cats facility to perform an unannounced inspection of two tiger cubs. But at the time the inspectors entered the facility, the cubs were at a veterinarian's office receiving treatment. Big Cats sued the APHIS inspectors for the unauthorized entry and asserted that the entry was an illegal search under the Fourth Amendment and sought declaratory judgment and compensatory and punitive damages. The United States District Court for the District of Colorado,  granted APHIS's motion to dismiss in part and denied in part. APHIS appealed. The Court of Appeals, held that: (1) Big Cats could assert a Bivens claim; (2) Big Cats adequately alleged that the inspectors violated their Fourth Amendment right to be free from unreasonable searches and seizures; and (3) Big Cats had clearly-established the constitutional right to be free of unreasonable searches or seizures, thus weighing against the inspectors' claim of qualified immunity; but (4) the inspectors did not act under the color of state law, as required for § 1983 liability. The Court of Appeals reasoned that Big Cats' complaint stated a claim for relief under Bivens because No APHIS inspector would reasonably have believed unauthorized forcible entry of the Big Cats facility was permissible. Also, the Court reasoned that when the agents cut the locks to conduct a non-emergency inspection without a warrant, the federal officials did not act under color of state law, and the district court erred in denying the government's motion to dismiss the § 1983 claim. Therefore, the Court of Appeals affirmed the district court's order denying the government's motion to dismiss the Bivens claim and reversed the trial court's order denying the government's motion to dismiss the § 1983 claim.

Milburn v. City of Lebanon

Summary: Plaintiff Milburn was acquitted of misdemeanor animal abuse on appeal, but a Lebanon police officer removed Milburns’ dog from her possession. While the appeal was pending, the Defendant, City of Lebanon, gave the dog to an animal shelter. The dog was later adopted by a new owner. The Linn County Circuit Court ordered the City to return the dog to Milburn after the acquittal but the Defendant City failed to comply. Milburn then brought this action pursuant to 42 U.S.C. §§ 1981 and 1983 against the City of Lebanon. The City moved for dismissal for failure to state a claim, and the United States District Court, for the District of Oregon, granted that motion while giving leave for Milburn to amend her complaint. In the Amended Complaint, Milburn contended that the City’s refusal to return her dog pursuant to the state court order deprived her of property without due process of law, in violation of the Fourteenth Amendment. Milburn also asserted a violation of her procedural due process rights. The United States District Court, for the District of Oregon, reasoned that while Milburn alleged a state-law property interest in her dog, she failed to allege that the Defendant City deprived her of that interest without adequate process. Milburn also did not allege state remedies to be inadequate. Those two omissions in combination were fatal to Miburn's procedural due process claim. Also, Milburn's assertion that the court issued an order and that the City did not comply with, is an attack on the result of the procedure. The court reasoned that attacking the result instead of the process of a procedure does not state a procedural due process claim. Milburn’s procedural due process claim was then dismissed. The Court also held that it did not have jurisdiction over Milburn’s injunctive relief claim. Therefore, Milburn's request for injunctive relief was dismissed with prejudice. However, the court held that Milburn could seek monetary damages. While Defendant City’s second motion to dismiss was granted, Milburn was granted leave to amend her complaint within 90 days with regard to her claim for actual and compensatory damages.

People v. Meadows

Summary: Defendant Amber Meadows allegedly neglected to provide dogs Athena, Buddy, and Meeko, with air, food, and water, and confined them in a bedroom where feces was found on the floor and furniture. Meadows was prosecuted for three counts of the unclassified misdemeanor of failure to provide proper food and drink to an impounded animal in violation of § 356 of the Agriculture and Markets Law (AML). Meadows moved to dismiss the Information as facially insufficient and stated that the Supporting Deposition indicated that the dogs were “in good condition.” The People of the State of New York argued that the allegations in both the Information and Deposition, taken together, provide a sufficient basis to establish the elements of the crime. The Canandaigua City Court, Ontario County, held that: (1) “impounded” as stated in § 356 of the Agriculture and Markets Law does not apply to individual persons, and (2) even if the statute applied to individual persons, the allegations in the Information were not facially sufficient. The court reasoned § 356 does not apply to individual persons, but instead applies only to “pounds” operated by not-for-profit organizations, or kennels where animals are confined for hire. The court also stated that even if § 356 were to apply to individuals, under no construction of the facts here could the charge be sustained, as it appeared that the animals were properly cared for in the Defendant's apartment up to the point where she was forcibly detained. The conditions observed by law enforcement authorities on the date alleged in the Information were apparently several days after Meadow's incarceration and after which she was unsuccessful in securing assistance for the dogs while incarcerated. The Information was dismissed with prejudice, and the People's application for leave to file an amended or superseding Information was denied.

Arellano v. Broward

Summary: Plaintiff Lisa Arellano suffered a dog bite and injury to her big toe after being attacked by a guard dog. The Defendant, Broward K–9/Miami K–9 Services, Inc. (“K–9”), owned two guard dogs. The guard dogs escaped K-9 after the business was burglarized, and the chain link fence was cut. The dogs entered Arellano’s neighborhood and she believed that the dogs belonged to one of her neighbors. Arellano fed and sheltered the dogs for about five days, and took steps to find the dogs' owner. However, Arellano also had pet dogs of her own. Eventually, one of the guard dogs attacked one of Arellano's dogs. When Arellano intervened in the attack between the two dogs, she was injured. Eventually, Animal Control determined that K–9 owned the guard dogs. Arellano then brought a statuory damages claim for strict liability against K-9 under Florida’s dog bite statute. The Circuit Court, Miami–Dade County, entered summary judgment in favor of K-9 and determined as a matter of law, that Arellano's actions constituted a superseding, intervening cause, thereby precluding her statutory dog bite claim against the Defendant, K-9.  Plaintiff, Arellano appealed.  The District Court of Appeals, held that triable issues of fact existed as to whether, and to what extent, K-9's liability under the statute should be reduced because of allegedly negligent actions by Arellano. The Court of Appeals reversed and remanded the circuit court decision and reasoned that Florida's dog bite statute imposes strict liability on dog owners, subject only to a plaintiff's comparative negligence, which in this case must be determined by the trier-of-fact. K-9's liability under the statute should only be reduced because of the allegedly negligent actions of Arellano. The court also reversed the resulting cost judgment in K–9's favor. The case was remanded to the trial court.

IL - Restaurant - 5/11-20-14. Companion dogs; restaurants

Summary: This law provides that a municipality with a population of 1,000,000 or more may, by ordinance, authorize the presence of companion dogs in outdoor areas of restaurants where food is served, if the ordinance provides for adequate controls to ensure compliance with other Illinois health laws. An ordinance enacted under this Section shall provide that: (i) no companion dog shall be present in the interior of any restaurant or in any area where food is prepared; and (ii) the restaurant shall have the right to refuse to serve the owner of a companion dog if the owner fails to exercise reasonable control over the companion dog or the companion dog is otherwise behaving in a manner that compromises or threatens to compromise the health or safety of any person present in the restaurant. Under this law, "companion dog" means a dog other than one who is assisting a person with disability.

Summary: This chapter effective October 1, 2016 states that the intent is to enhance animal shelter services by promoting humane animal sheltering policies and strengthening community safety. Before January 1, 2017, an animal shelter shall establish a written veterinary care protocol for dogs and cats that is consistent with guidelines set forth in the most recent Association of Shelter Veterinarians' Guidelines for Standards of Care in Animal Shelters. That same date, an animal shelter must post on the animal shelter's Web site or in a conspicuous location within the animal shelter's facility a written protocol for reclaiming animals from the animal shelter that includes the minimum holding period for stray animals, the hours of operation, the fees for reclaiming an animal, and the documentation/identification required for reclaiming. Violation of this subtitle results in a civil penalty of $500.

MD - Swap Meets - § 19-105. Sales or other transfers of dogs or cats at public places

Summary: This 2016 law states that a person may not offer for sale, sell, offer to transfer, transfer, barter, trade, or auction a dog or cat at any public place, including a street, parking lot, carnival, swap meet, or fair, among others. The act does not apply to an animal welfare organization or animal control unit displaying dogs or cats for adoption or a prearranged sale of a dog by a dog breeder if not a recurring event. Violation results in a $500 civil penalty for a first violation, a $1,000 civil penalty for a second violation, and a civil penalty for a $1,500 for a third or subsequent violation.

Keep Michigan Wolves Protected v. State, Dep't of Nat. Res.

Summary: Plaintiff, Keep Michigan Wolves Protected (KMWP), appealed an order of the Court of Claims concluding that PA 281 does not violate Michigan's Constitution or statutes, and the granting of summary disposition in favor of defendants, the State of Michigan, the Department of Natural Resources, and the Natural Resources Commission. The issue began in 2011 when the U.S. Fish and Wildlife Service removed gray wolves from the federal list of endangered species, returning management of wolf populations to Michigan. In 2012, the governor of Michigan signed PA 520 into law, which added the wolf to the definition of "game" animals. Plaintiff KMWP organized a statewide referendum petition drive to reject PA 520 at the November 4, 2014 general election, which would have rendered PA 520 ineffective unless approved by a majority of voters. In 2013, Michigan's Governor signed into law PA 21 and PA 22, which granted the Natural Resources Commission (NRC) authority to manage wolves. In addition, the laws also gave qualified members of the military free game and fish licenses. Another petition drive was initiated by plaintiff and required signatures were collected to place the issue on the November 2014 ballot. However, in December 2013, before this, Citizens for Professional Wildlife Management (CPWM) circulated a petition to initiate the Scientific Fish and Wildlife Management Act also known as PA 281. This new law would reenact PA 520 and 21, giving the NRC authority for designating game animals, offering free military hunting and fishing licenses, and appropriating $1 million to manage invasive species. In May of 2014, the CPWM certified this initiative petition and submitted directly it to the Legislature to enact or reject the law. The Legislature adopted the law, which became known as PA 281. Notably, at the November 2014 election, a majority of voters rejected PA 520 and PA 21. Regardless, PA 281, which included the voter-rejected designation of the wolf as a game species, was signed into law and the NRC designated wolves as a game species effective March 2015. Following this, plaintiff filed the underlying complaint that challenged the constitutionality of PA 281, specifically that it violated the Title–Object Clause of Michigan's Constitution, Const 1963, art 4, § 24, which states that (1) a law must not embrace more than one object, and (2) the object of the law must be expressed in its title. The Court of Claims granted defendants' summary disposition motion, holding the the general purpose of PA 281 is to “manage fish, wildlife, and their habitats” and that all of the law's provisions relate to this purpose, and concluded that the law did not violate the single-object requirement of the Title–Object Clause. The Court of Appeals found that some provisions of PA 281 did not violate the Title-Object Clause including (1) free licenses to military and (2) appropriating $1 million to respond to the threat of invasive fish species. However, the court did find that the free licenses to members of the military has no necessary connection to the scientific management of fish, wildlife, and their habitats violating the single-object rule of the Title-Object Clause. While the court noted that there is a severability option with provisions of laws that violate the Title-Object Clause, the court cannot conclude the Legislature would have passed PA 281 without the provision allowing free hunting, trapping, and fishing licenses for active members of the military. Thus, this provision cannot be severed from PA 281, and, consequently, the court found PA 281 is unconstitutional. The court noted that its decision rests solely under an analysis of the Michigan Constitution and related cases. However, the court noted that plaintiff's assertion that the initiating petition by defendant put "curb appeal" of free military licenses and invasive species control to "surreptitiously" reenact a provision that would ensure wolves would be on the game species list was an "accurate" assessment. The court even said that PA 281 "conjures up images of a Trojan Horse, within which the ability to hunt wolves was cleverly hidden." The order granting summary judgment for defendants was reversed and the matter was remanded.

Trophy Hunting Contracts: Unenforceable for Reasons of Public Policy

Summary: Contracts that are considered “unsavory,” “undesirable,” “at war with the interests of society,” or “in conflict with the morals of the time” may be declared unenforceable for reasons of public policy regardless of whether or not any underlying legislation provides that the contractual conduct is illegal. Allowing wealthy individuals to kill some of the very last few specimens of rare species has become so distasteful to so many members of the general public that the time has come for courts to declare such contracts unenforceable for reasons of public policy. This Article demonstrates how this may be accomplished. The Article also examines the wildlife-protective capabilities of the public trust doctrine and the closely related state ownership of wildlife doctrine. These doctrines add further weight to the contractual argument, but also operate as stand-alone protective doctrines in lawsuits against government entities. To be able to present any of these arguments to a court of law, standing is a hurdle, but one that can be overcome. This Article highlights how this might be done.

The Article also examines the wildlife-protective capabilities of the public trust doctrine and the closely related state ownership of wildlife doctrine. These doctrines add further weight to the contractual argument, but also operate as stand-alone protective doctrines in lawsuits against government entities. To be able to present any of these arguments to a court of law, standing is a hurdle, but one that can be overcome. This Article highlights how this might be done.

Tighe v. North Shore Animal League

Summary: In May 2012, Tighe adopted a dog from the North Shore Animal League after having been warned that the dog was possessive regarding food. After taking the dog home, Tighe noticed that the dog exhibited aggressive behavior, such as jumping at the backyard fence and growling at her when she attempted to feed the dog. In July of 2012, the dog bit Tighe’s hand when she tried to pick up a cookie off of the floor. As a result, Tighe spent three days in the hospital due to severe blood loss and swelling. Additionally, in September of 2012, the dog bit Tighe in the face causing severe injuries. After the incident in September, Tighe filed suit against the North Shore Animal League to recover damages for negligence, breach of implied warranty of merchantability, and intentional infliction of emotional distress. The court dismissed the claim of emotional distress but granted summary judgment in favor of Tighe with regard to the other claims of negligence. The North Shore Animal League appealed the lower court’s decision. Ultimately, the Supreme Court of New York overturned the lower court’s decision and granted summary judgment in favor of the North Shore Animal League on all claims. The court found that the North Shore Animal League was not a proximate cause to Tighe’s injuries for failing to adequately warn her about the dog’s aggreesive behavior because Tighe learned of the dog’s aggressive behavior three months prior to the incident that caused Tighe’s injuries. According to the court, once Tighe learned of the dog’s aggressive tendencies, she was in the best position to take “precautionary measures to prevent harm to herself.” So, even if the North Shore Animal League had failed to warn Tighe of the dog’s aggressive tendencies prior to the adoption, Tighe “independently” learned of the dog’s aggressive behavior prior to the incident which eliminated the North Shore Animal League as being a proximate cause of her injuries.
