Summary: Several reports to the police were made that a man had threatened several individuals with a firearm. In responding to the calls, the police identified the plaintiff pet owner as the allegedly armed man. Officers then proceeded to the plaintiff’s home and acknowledged that they saw a “Beware of Dogs” sign, but still entered the fenced-in premises. Upon entering the yard, four dogs approached and one of the officers shot and killed one of the dogs. The plaintiff brought suit against the officer and municipality and alleged violations of his Fourth and Fourteenth Amendment rights. In evaluating the officer’s claim of qualified immunity, the court held that the officer’s actions were objectively reasonable, considering he had reason to believe the plaintiff may be armed and dangerous and claimed “several large dogs ran out aggressively charging, barking and growling.” The officer’s relation of events was backed up by his fellow officer on the scene.

Summary: In this case, the plaintiff’s dog was shot by a police officer who was responding to the plaintiff’s call for police assistance in investigating a bank fraud matter. Upon arrival at the home, the officer entered the low-fenced front yard and two of the plaintiff’s dogs approached. The officer, the only eyewitness to the encounter, then shot and killed one of the plaintiff’s dogs. The plaintiff filed suit against the officer and municipality, and alleged, inter alia, violations of her Fourth Amendment rights, intentional infliction of emotional distress, and violations of state statutes. The court held that enough factual issues were disputed to deny the defendants’ motion for summary judgment, specifically that there was a genuine dispute as to whether the killing of the dog was reasonable.

Summary: While executing a search warrant at the plaintiff’s home, a police officer shot and killed the plaintiff’s thirteen-year-old dog. Accounts differed as to whether the dog bit the officer before shooting or whether the bite was a result of the shooting. The plaintiff filed suit against the police officer and municipality and alleged, inter alia, violations of her constitutional rights, several common law torts, and intentional infliction of emotional distress. The court was not swayed by the plaintiff’s “uncorroborated version of events” and granted summary judgment in favor of the defendants. The court held that the plaintiff had not met her burden to defeat either the individual police officer’s or the municipality’s immunity. This case is under appeal as of September 15, 2015.

Summary: The plaintiff’s dog was shot by a police officer while eyewitnesses claim that right before he fired, the dog was stationary or retreating at a distance of 10-20 feet from the officer and his police K9. The pet owner filed suit against both the individual police officer and the municipality, who both claimed immunity, which was granted at the trial court. On appeal, the court upheld the dismissal of the municipality based on the fact that official policy did “not authorize unconstitutional conduct or give officers unbridled discretion to shoot any animal they encounter, even if it is not threatening.” However, the appellate court reversed the trial court’s decision in regards to the officer’s immunity, holding that viewing the circumstances in the light most favorable to the plaintiff, the killing was not necessarily reasonable to protect the officer’s safety or the safety of his police K9.

Summary: The Plaintiff-Appellant appeals a decision/order by the lower court to deny her motion to set aside the jury verdict or grant a new trial. At the original trial, a jury found plaintiff failed to prove her 42 U.S.C. § 1983 claim that the shooting of her dog during the execution of a search warrant was an unconstitutional seizure in violation of the Fourth Amendment. Plaintiff's dog was shot during a "no-knock" search warrant at plaintiff's residence, but the warrant team was aware that a dog would be present during the search. On appeal, this court held that the plaintiff was not entitled to a new trial because she failed to provide any “legally sufficient evidentiary basis” to show that the jury would find in her favor. The court believed that it was unlikely that a jury would find in her favor because of the fact that the dog was killed during a “no-knock” search of the home and the dog “quickly and aggressively” ran towards the police officer after he entered the home. Although the court agreed that the officers should have advised a plan to deal with the dog in a non-lethal way, it maintained that a jury would unlikely find that the officer’s use of force was unreasonable given the circumstances of this case. Affirmed.

Summary: Blu, a pit bull was shot in the head and killed after Officer Johnson entered the pit bull’s yard. The Plaintiffs, who were owners of Blu, filed a complaint asserting a: violation of the Fourth and Fourteenth Amendments by shooting and killing Blu (Count I); violation of Plaintiffs' constitutional rights due to the City's failure to adequately hire, train, and supervise Johnson (Count II); intentional infliction of emotional distress (Count III); negligent hiring, supervision, and retention of Johnson (Count IV); vicarious liability (Count V); and trespass and conversion (Count VI). The Defendants, Officer Johnson and the City of Minneapolis, filed a Motion for Summary Judgment. The court held that the Motion would be granted in part. The court reasoned that Blu was property, rather than a person, for Fourth Amendment purposes and the officer's shooting and killing of Blu constituted a “seizure.” However, the court concluded that Officer Johnson was entitled to qualified immunity on Plaintiffs' Fourth Amendment claim. The court reasoned that it was not unreasonable for the Officer to perceive a threat to his safety when the large pit bull jogged up behind him. The court also held that The Motion for summary judgment was granted as to the remaining claims because the evidence in the record, failed to establish a constitutional violation by Defendants.

Summary: Sadie, a six (6) year old pit bull and family pet was shot and killed by the Defendant Officer Wittlinger. The Plaintiff, Sadie’s owner, filed a twelve count complaint alleging four § 1983 claims under federal law against all Defendants including the borough, police department, board of supervisors, police chief, and Officer Wittlinger. The remaining eight counts alleged claims solely against the officer. The Defendants' filed a partial motion to dismiss for failure to state a claim. The Court granted the dismissal of claims against the board, police chief, and officer in their official capacities. The court also dismissed the Plaintiff’s state negligence claims. However, the court did not dismiss claims brought against Police Chief Bazzone and Officer Wittlinger in their individual capacities. The court reasoned that the facts pled by the Plaintiff were sufficient to show that Chief Bazzone may have acted with deliberate indifference by not disciplining Officer Wittlinger after a prior dog shooting incident, and maintained a custom within the Police Department that it was proper to shoot a pet dog wandering the streets. The court also denied the motion to dismiss Plaintiff’s fourth amendment rights claim. The court reasoned that the facts pled by the Plaintiff were sufficient to state a claim for violation of her Fourth Amendment rights because the plaintiff had a possessory interest in her dog Sadie as “property” and the officer used excessive force while seizing the Plaintiff’s property.

Summary: On March 30, 2012, Plaintiff and the Fair Housing Center of West Michigan (“FHCWM”) brought suit against Defendants, a university, alleging unlawful discrimination under the Fair Housing Act (“FHA”), Federal Rehabilitation Act, and Michigan Persons with Disabilities Civil Rights Act (“PWDCRA”), for denying Plaintiff’s request to keep an emotional support animal in on-campus housing. All claims brought against the individual defendants were brought against them in their official capacities as university administrators. Plaintiffs sought both injunctive and compensatory relief. Defendants filed a motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1), lack of subject matter jurisdiction, and 12(b)(6), failure to state a claim upon which relief can be granted. The District Court decided the following would be dismissed: (1) all claims under the PWDCRA against all defendants; (2) all claims for compensatory damages under the FHA brought against all defendants; (3) all claims for injunctive relief under the FHA brought against the institutional defendants; (4) all claims for relief under the Rehabilitation Act by the FHCWM; and (5) all claims for relief under the Rehabilitation Act by Plaintiff that depended on disparate treatment. The following claims remained: (1) Plaintiff and the FHCWM's claims under the FHA seeking injunctive relief from the individual defendants; and (2) Plaintiff's claims against all defendants for compensatory damages and injunctive relief under the Rehabilitation Act pursuant to the failure to accommodate theory.

Summary: Plaintiffs brought the instant suit contending that their Condo Board's refusal to accommodate the need for an emotional support animal forced them to sell their condo. The Defendants moved to dismiss for failure to state claims upon which relief could be granted. After finding that Plaintiffs were not entitled to unrestricted access for their dog despite a no pet waiver and after needing more facts to determine whether Defendants restrictions on Plaintiffs’ access to the building were reasonable, the District Court denied Defendants' motion to dismiss Plaintiffs' claims under the Federal Housing Amendments Act (FHAA) and the Illinois Human Rights Act (IHRA). The District Court also found Plaintiffs' interference or intimidation allegations sufficient to withstand a motion to dismiss. However, the District Court dismissed Plaintiffs’ nuisance claim because Plaintiffs had not contended that Defendants unreasonably used their own property to interfere in Plaintiffs' use and enjoyment of their home, but rather, contended that Defendants made rules that interfered with the Plaintiff's ability to use the common areas of the property as they wished. Plaintiffs’ intentional infliction of emotional distress claim was also dismissed because Plaintiffs had not sufficiently alleged that Defendants' conduct was extreme or outrageous. Finally, the constructive eviction claim was dismissed because more than a year had past between the owners’ accommodation request and the sale of their condominium. In sum, Counts I, II, and III went forward, but the remainder of the complaint was dismissed. Additionally, Defendant Sudler Building Services was dismissed from the complaint.

Summary: Plaintiff brought this action pursuant to Title II of the Americans with Disabilities Act (the “ADA”), Section 504 of the Rehabilitation Act of 1973, and New York State and New York City laws, alleging that the New York City Transit Authority (“NYCTA”) and the Manhattan and Bronx Surface Transit Operating Authority (“MaBSTOA”) (collectively, “Defendants”) failed to ensure that their vehicles and facilities were accessible to her and other persons with disabilities who utilize service animals. Defendants moved for summary judgment, arguing that Plaintiff (1) was not disabled, (2) was not entitled to use a “service animal,” (3) was seeking to bring dogs which do not qualify as “service animals” onto Defendants' vehicles; had not made out a Title II claim and (5) could not make out a claim for intentional infliction of emotional distress. Defendants' motion for summary judgment was granted only with respect to that portion of the eleventh cause of action that alleged intentional infliction of emotional distress. The parties were also directed to submit supplemental briefing.
